1. Eligibility and accounts

You must be at least 18 years old and able to form a binding contract to use the Services. If you use the Services on behalf of a business, you represent that you are authorized to bind that business to these Terms. You are responsible for keeping your account credentials secure and for all activity under your account.

2. The Services

VoiceGenix.ai provides an AI voice receptionist that answers calls, understands caller intent, routes calls, captures leads, and produces recordings, transcripts, summaries, and related reporting for our customers. We may add, change, or remove features over time.

3. Free trial

We may offer a 30-day free trial. The trial is provided at no charge, and you may choose not to continue at any time during the trial with no obligation. Unless you continue to a paid plan, the Services may become unavailable at the end of the trial. We may modify or discontinue trial offers at our discretion.

4. Fees and billing

• Paid plans are billed at the price and on the schedule presented when you subscribe. The Core plan is a fixed monthly fee that includes a set amount of answered call time; Custom plans are priced individually.
• Fees are stated in US dollars and, unless noted otherwise, are exclusive of applicable taxes.
• Except where required by law, fees are non-refundable. You can cancel future renewals as described in your account or by contacting us.

5. Acceptable use

• Use the Services for any unlawful, harmful, deceptive, or fraudulent purpose.
• Violate the rights of others, including privacy and intellectual property rights.
• Interfere with, disrupt, or attempt to gain unauthorized access to the Services or related systems.
• Use the Services to send unlawful telemarketing, spam, or robocalls, or in a way that violates telecommunications or consumer-protection laws.
• Reverse engineer or attempt to extract source code, except as permitted by law.

6. Call recording and consent

The Services record and transcribe calls. You are responsible for providing any notices and obtaining any consents required by the laws that apply to your calls, callers, and locations. You are responsible for how you use recordings, transcripts, and captured information.

7. Customer content and data

You retain ownership of the content and data you and your callers provide through the Services. You grant us the rights needed to operate and improve the Services, as described in our Privacy Policy. You are responsible for the accuracy and legality of the content you provide.

8. Intellectual property

The Services, including software, designs, text, and branding, are owned by VoiceGenix.ai or our licensors and are protected by law. We grant you a limited, non-exclusive, non-transferable right to use the Services in accordance with these Terms. All rights not expressly granted are reserved.

9. Third-party services

The Services may integrate with or link to third-party products, such as CRMs and telephony providers. We are not responsible for third-party services, and your use of them is governed by their own terms.

10. Disclaimers

The Services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or that every call will be handled without fault. Any figures or examples on our website are illustrative and are not a guarantee of results.

11. Limitation of liability

To the fullest extent permitted by law, VoiceGenix.ai will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or business, arising out of or related to your use of the Services. Our total liability for any claim will not exceed the amount you paid us for the Services in the twelve months before the claim.

12. Indemnification

You agree to indemnify and hold harmless VoiceGenix.ai and its officers, employees, and agents from claims, damages, and expenses arising out of your use of the Services, your content, or your violation of these Terms or applicable law.

13. Termination

You may stop using the Services at any time. We may suspend or terminate access if you violate these Terms or if we discontinue the Services. Provisions that by their nature should survive termination will survive.

14. Governing law

These Terms are governed by the laws of the United States and the state in which VoiceGenix.ai is established, without regard to conflict-of-laws rules. Disputes will be resolved in the courts located there, unless otherwise required by applicable law.

15. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Services after changes take effect means you accept the updated Terms.
